Code of Conduct

The Norwalk Library prioritizes a high-quality experience for all patrons. To ensure safety, comfort, and enjoyment, we enforce a code of conduct. Our staff does so politely but firmly, and we appreciate employee cooperation in maintaining a secure and pleasant environment for all visitors. 

Under Ohio Revised Code Section 3375.40(H), the Norwalk Public Library Board of Trustees establishes rules for public behavior. These rules serve several purposes: 

  • Environment: Maintain a conducive library environment for patrons and staff.
  • Access: Enable maximum use of facilities, materials, and services by all individuals.
  • Preservation: Safeguard facilities and materials from harm.
  • Safety: Ensure the safety of Library patrons and staff.

Unacceptable Behavior

Unacceptable behavior is not permitted. Unacceptable behavior includes, but is not limited to:

  • Legal Violations: Any activity violating federal, state, or local laws is prohibited. This includes theft, trespassing, assault, arson, and indecent exposure.
  • Disruptive Conduct: This includes harassment, excessive noise, intimidation, and abusive language.
  • Property Misuse: Theft, damage, or defacement of Library materials, equipment, or others’ property is not allowed.
  • Loitering: Avoid congregating near elevators, entrances, or stairways.
  • Sleeping: Not permitted.
  • Weapons: Prohibited except for sworn law enforcement officers.
  • Solicitation and Surveys: Avoid distributing literature or asking for signatures within the Library.
  • Smoking and Vaping: Not allowed on Library property.
  • Substances: Avoid alcohol, unauthorized drugs, or controlled substances.
  • Cell Phones and Devices: Set to silent or vibrate mode; use headphones for noise-emitting devices.
  • Photography/Recording: Obtain permission before capturing patrons or staff.
  • Gambling and Panhandling: Prohibited for personal profit.
  • Trespassing and Eviction Violation: Avoid entering when banned.
  • Supervision of Minors: Ensure proper supervision.
  • Animals: Allowed only as provided by law (e.g., service animals).

Dress Code

Patrons must have appropriate attire, be fully dressed, including shoes and a shirt. Visible or damp swimming suits are not suitable. Vulgar or Inappropriate Clothing is not permitted. Patrons with an excessive amount of offensive odor or substance like grease, oil, etc., that can be transferred to other patrons, Library furnishings, or equipment will not be permitted in the Library. Penalties for not adhering to these guidelines include being asked to leave the premises for a specified amount of time or even losing Library privileges. It is not the Library’s intent to enforce a strict dress code, but if a patron is disruptive to staff or others, the person will be asked to comply or leave the Library.

Consequences of Impermissible Behavior

Rules and consequences are based on powers granted to a Public Library Board of Trustees under Ohio Revised Code 3375.40 (H).

  1. Verbal Warning: Library staff may issue a verbal warning to the patron, explaining the violation and reminding them of the rules.
  2. Temporary Suspension: For more serious violations, the patron may be asked to leave the Library premises for a specified period (e.g., a day, a week, or a month).
  3. Loss of Library Privileges: Repeated or severe violations can result in the patron losing Library privileges. This means they will not be able to borrow materials, use computers, or participate in Library programs.
  4. Involvement of Law Enforcement: In extreme cases (such as physical violence, threats, or illegal activities), Library staff may involve law enforcement. Police officers may issue citations or make arrests if necessary. Adult patrons or minor child patrons may also be prosecuted under Ohio Revised Code Title 29 of Ohio law for acts against the Library personnel or property. 

Procedure for Suspension

Notice of suspension, incident report(s), and a copy of the Conduct Code will be mailed to the patron's last known address or, in the case of a minor child, the child’s parents or guardian.

Appeal of the suspension may be made by speaking with a Library supervisor or submitting a written request to the Director, within seven (7) days of receipt of suspension. The Library administration will review the case. This may involve discussing the incident with the patron, examining any evidence, and considering the severity of the violation.

If the patron disagrees with the initial decision, they may request an appeal hearing. The patron, or in the case of a minor child, the parents or guardian, will be notified by the Director of the date and time of the hearing on the written notice of appeal. During the hearing, the patron can present their side of the story and provide any relevant information. After the appeal hearing, the Library administration will make a final decision. This decision is typically communicated in writing to the patron.

The suspension and appeal process applies to violations of basic Library rules and etiquette. In cases of severe misconduct that endangers others, the supervisor, or Director will report to the Norwalk City Police Department. The Board of Trustees may then impose an immediate permanent suspension after review and deliberation.
